How would you grade the system? SEAN: Joe, overall I would say the court system is failing in the area of special needs due to a systematic lack of compassion and quite frankly, equality in Justice. The court system is not designed to naturally allow people with disabilities to be treated fairly without some 3rd party assistance. It seems unimaginable in the 21st century, but it’s a reality within the intellectually challenged community. Joe, a good example of what I am taking about is; I have a Department of Development Services client that was indicted in Superior court with an IQ of a 40. He was never arrested, but sent a summons to go to court. My client cannot read or write, but his guardian told him he needed to go to court. He showed up to court with no idea on why he had to go and was appointed a lawyer. The lawyers first question was “is your intellectual disability curable?” I’ll admit, even I was taken back by the question. It’s not the lawyers fault, they don’t go to law school to learn about people’s disabilities, however, it’s a systemic issue. It’s an example how far removed many criminal lawyers are from understanding their clients with disabilities. JOE: Wow, you just wouldn’t think that’s possible in today’s society. SEAN: Unfortunately, it is Joe.
